MOTION TO DISMISS APPEAL 
  

NOW COME the Appellees in the above styled action 

and respectfully move the Court to dismiss the appeal in 

galid action for want of jurisdiction on the part of this 

Court, and in support thereof would show that there was 

no action or order of the lower Court which is appealable 

under Section 1291, U.S.C. 

The motion filed by Appellants in this case in the 

District Court was not noticed for any time or place, and 

the only pleading served upon Appellees was the motion 

itself; that thereafter the District Court, in ites discre- 

tion, set this case for evidentiary hearing at 9:00 a.m. 

on October 8, 1968. 

No order or decree has been entered by the District 

Court in this case since the filing of Appellants’ motion, 

and therefore this case in ites present status is not 

appealable; there is no jurisdiction on the part of this 

Court. 

It is respectfully submitted that this appeal should 

be dismissed for want of jurisdiction.
