As you know, we sti'l I have not received the transcript
of the closing arguments from the court reporter. I spoke
with tlilbur Miller, Judge Hobbs' law clerk this afternoon and
he is still express'i ng some concern for an 0rder from Judge
Hobbs' that the transcript be produced, inasmuch as ,,the
court reporter is not a party to this action". He was some-
wh at I ukewarm to my ar gumen t th at the court reporter , under
the circumstances, was an agent of the State of Alabama,
which is a party to this action.
In any case, he further indicated that Judge Hobbsprobably wou ld not order the District Attorney to produce
copies of the out-of-court statements, so we may be headed
for a heari ng on that one. As soon as he "deci des to
decide", I wi'l I let you know.
