On February 23, 1988, Appellees filed a motion for 

leave to supplement their brief with a partial transcript of 

the proceedings in Clark V. Edwards, United States District 

Court for the Middle District of Louisiana, No. 86-435. 

By minute entry dated February 25, 1988, the court in 

Clark noted that the Sixth Circuit's decision in Mallory v.  

Eyrich, No. 87-3838 (February 12, 1988), may affect the ruling 

in Clark. 

Pursuant to Loc. Rule 28.3 (I.O.P.), Appellees wish to 

call this to the Court's attention and respectfully withdraw 

the Motion to Supplement Appellees' Brief filed on February 23, 

1988.
