MOTION FOR CONTINUANCE

Nov* come the State defendants, William G. Mi n  i Ven 
Governor of the State of Michigan, Frank J. Kelley, Attorney General 
of the State of Michigan, Michigan State Board of Education and 
John W. Porter, Superintendent of Public Instruction, by their 
attorneys, Eugene Krasicky and Gerald F. Young, Assistant Attorneys 
General, and respectfully move this Honorable Court to set over the 
hearing scheduled for February 8, 1371 until February 11, 1971.

The State defendants respectfully submit that oral argu­
ment before the United States Court of Appeals on plaintiffs’ second 
interlocutory appeal in the above-entitled cause, is scheduled for 
February 9, 1971 and the attorneys for the various parties are 
ordered on the above said date to report to the Clerk’s Office for 
the United States Court of Appeals by 8:45 A.M. in Cincinnati, Ohio.

Since the attorneys, for the State defendants will need time in 
which to prepare for the oral argument before the Court of Appeals 
and will also need time in which to travel to Cincinnati, Ohio, 
they will be unable to adequately meet and prepare for the hear­
ing scheduled before this Court on February 8, 1971. Therefore, 
the State defendants request this Court to set over the hearing 
scheduled for February 8, 1971 until February 11, 1971.

This motion shall be brought on for a hearing at such 
time and on such date as this Court shall order.
