On the 12th day of January 1970, an order was issued by 

the Fifth Circuit Court of Appeals ordering this Court to hold 

an evidentiary hearing on the substitute plan of desegregation 

- approved by the Fifth Circuit Court of Appeals in its order of | 

November 26, 1969, in accordance with the procedure set out in | 

its order dated November 7, 1969; and further placing the burden | 

of proof upon the defendants to demonstrate that the substitute 

plan was devised and promulgated for educational purposes only. 

In accordance with such order of said Court, a hearing

is hereby ordered on the 20th day of April, 1970 in the Federal 

Building in Hattiesburg, Mississippi at 9 a.m. o'clock.

It is further ordered that plaintiff respond by filing

its response with the Clerk of the Court, Hattiesburg Division, 

no later than April 15, 1970, and by filing a copy directly ithe

said date.

copy of this Order to all parties of record, including copies to
