ON CONSIDERATION WHEREOF, it is ordered and adjudged by this Court that the judgment of the United States Court of Appeals in this cause is reversed with two-thirds costs; and that this cause is remanded to the United States Court of Appeals for the Fifth Circuit for further proceedings in conformity with the opinion of this Court. IT IS FURTHER ORDERED that the appellant, City of Mobile, Alabama, et al., recover from Wiley L. Bolden, et al.
