A certified copy of the judgment of this Court
in the above-entitled case has been mailed today to the Clerk
of the United States Court of Appeals for the Fifth Circuit.
The total costs in this Court are as follows:

TOTAL: $3,062.70
The appellants, City of Mobile, Alabama,
et al., are given recovery of two-thirds of the total costs
in this Court which amounts to $2,041.80. This amount may
be collected through the United States Court of Appeals for
the Fifth Circuit or direct fram opposing counsel or parties.

APPEAL from the United States Court of Appeals for the Fifth
Circuit.
THIS CAUSE came on to be heard on the transcript of the
record from the United States Court of Appeals for the Fifth Circuit,
and was argued by counsel.
ON CONSIDERATION WHEREOF, it is ordered and adjudged by this
Court that the judgment of the United States Court of Appeals in this
cause is reversed with two-thirds costs; and that this cause is remanded
to the United States Court of Appeals for the Fifth Circuit for further
proceedings in conformity with the opinion of this Court.
IT IS FURTHER ORDERED that the appellant, City of Mobile,
Alabama, et al., recover from Wiley L. Bolden, et al. Two Thousand
Forty-one Dollars and Eighty Cents ($2,041.80) for their costs herein
expended.
