The above-styled case came before the court for a 

hearing on several motions, and the court having considered 

the motions and the argument of counsel, it is 

ORDERED AND ADJUDGED: 

l. It appearing that this case has not yet been tried 

or decided on the merits by either this court or the Fifth 

Circuit, plaintiff's motion to modify the March 9, 1977 

order as to the scope of the issues at trial of this cause 

ls GRANTED. . Trial of this action shall include evidence 

and argument directed toward all four of the voting di- 

lution criteria outlined in Zimmer v. McKeithen, 485 F.2d 1297 

{5th Cir. 1973) {en banc), and Nevitt v. Sides, 571-F.2d 

209 45th Cir.-.1978). 

2. Plaintiff's motion to establish law of the case 

or in the alternative request for judicial notice regarding 

alleged racial motivation behind the establishment of the 

at-large election system for school boards is DENIED. 



3. Plaintiff's motion to add a witness to the pre- 

trial stipulation is GRANTED. 

4. Defendants' unopposed motion to amend answer is 

GRANTED.
