T/1.^o)^ Lani Guinier April 4, 1986 Julius I gather from our meeting on Friday tlat you do not want LDF on the original petition in the California Supreme Court. I disagree with this decision for the following reasons: 1. The document we have is the memo- randum in suPPort of the Petition, not the petition itself- 2. The attorneY for the ACLU who is drafting the Petition has done this on 2 prior, more controver- sial cases, both of which the California Supreme Court took. 3. If the Court denies the writ, it will simplY send it back to the Superior CourtPIus nothing, except 2 weeks, will be lost (the time in which t'he Court will decide whether to take it). 4.
