Dear PauI:

f am enclosing copies of the amended courplaint and
papers pertaining to the notion to disniss. (The only
thing I have not copied is my cover letter to the couit
enclosing a copy of Judge Barbourrs decision in Kirksey
& Martin v. Allain.) As I told you on the phone this
afternoon, we shall definitely be appealing Judge
Schwartz's decision. f will send you a copy of the
judgrnent and notice of appeal as soon as I get them.

If you want anything else, please give ure a caII.
I hope that the Department will decide to participate
on our side in the Court of Appeals.
