COLLINS, J.

BARBARA MAJOR, ET AL. CIVIL ACTION

VERSUS NO. 82-1192

DAVID C. TREEN, ET AL. SECTION '"D" (C)

coon J TR dR SE SR TES SC

The above captioned matter came before the Court for a

hearing on April 14, 1982 at 9:00 a.m., on plaintiffs’

motion to consolidate this action with another case, Robert

E. Couhig, Jr. v. James L. Brown, Secretary of State, State

of Louisiana, No. 82-1136 (E.D. La. 1982), pending before

this Court. The Major action was originally allotted to

Section H of this district and was temporarily transferred

to this section for a determination of the motion to con-

solidate. By Minute Entry, dated May 6, 1982, the Court

granted the defendant's motion to dismiss the Couhig action

on the grounds that plaintiffs' claim is premature and not

ripe for adjudication. In view of the Court's disposition

of the Couhig action, plaintiffs’ motion in the above

entitled matter to consolidate is moot.

WHEREFORE, the Court will and hereby does DENY as MOOT

plaintiffs' motion to consolidate.

IT IS FURTHER ORDERED that the above entitled matter be

transferred to Section H of this district for further

proceedings.
