Dear Ms. Carnes: 

The notice to counsel by the Clerk of the Court of Appeals, dated 
December 2, 1986, states that trial exhibits will not ordinarily 
be transmitted to the Court of Appeals. If a party deems it 
essential that exhibits be part of the record on appeal, it 
should designate specified exhibits in a letter to the district 
court clerk. 

We have received no notice of what exhibits, if any, may be 
designated by counsel for the appellants, Calhoun County and 
Lawrence County. On behalf of plaintiffs-appellees, Dillard, et 
al., we request that the record on appeal include the following 
exhibits: 

From the September 5, 1986, hearing: Plaintiffs’ Exhibits 
1-3 and 7-16. 

From the March 5, 1986, hearing: Plaintiffs’ Exhibits 1-200 
(there are not 200 exhibits; many of the numbers were not used or 
the exhibits were not admitted into evidence).
