PLEASE TAKE NOTICE that on Monday, December 20, 1971 
at 10:00 a.m., in the Courtroom of the Honorable Stephen Roth, 
8th Floor, Federal Building, in the City of Detroit, the under­
signed, on behalf of Defendant, Detroit School Board, will move 
to Quash the Civil Subpoena to Produce Document or Object served 
on Charles J. Wolfe, Acting General Superintendent, Detroit 
Public Schools, on December 16, 1971, for the following reasons:

1. The Notice of the Court dated December 13, 1971 
was stated as "Notice of Hearing on Motion to Present Plan at 
Board's Expense".

2. There is no indication in said Notice that the 
hearing on Monday, December 20, 1971 is a hearing on any plan.

3. That the subpoena is directed to material that 
is not necessary for the hearing as set by the Court.

4. This Motion is based upon the files and records 
in the above matter.

Attempts were made to ascertain the position of 
Plaintiff by calling Paul R. Dimond at a number listed in Detroit 
and phoning Louis Lucas and William Cadwell in Memphis, Tennessee 
All three gentlemen were not in at the time the call was made at 
about 11:00 a.m., December 17, 1971.
