Cross-Designations for the Joint Appendix 

Dear Tiare: 

In line with our earlier discussions and at the direction of 
my co-counsel, Robinson O. Everett, I am forwarding herewith 
Appellees’ Cross-Designations for the Joint Appendix in the above- 
referenced matter. : 

We noted that one of the items which you have designated for 
-inclusion is the Answer of Defendant -Intervenors, Smallwood, et al. 
(CD 27 & 112). These intervenors have now been admitted by the 
trial court as of June 22, 1998. However, Appellees believe that 
it is important to make clear that at the time of the hearing and 
of the Judgment now being appealed, the intervenors had not yet 
been admitted into the case and that this was only an answer 
tendered for. filing. This can be handled by some mutually 
agreeable notation at the point in the Joint Appendix where this 
answer appears or in some other way - perhaps by positioning it at 
the end of the Joint Appendix. In any event, I would appreciate 
your discussing this with me.
