Cons aTE Department of Health Services 714 P Street, Suite 1253 Sacramento, California 95814 Re: Medi-Cal CHDP lead blood assessments Dear Dr. Kizer: The National Health Law Program, the Natural Resources Defense Council, the NAACP Legal Defense and Educational Fund, the ACLU, and the Legal Aid Society of Alameda County have been retained by clients to pursue claims against the Department of Health Services with regard to the Department’s failure to comply with mandatory federal Medicaid guidelines that require the Department to detect and treat lead blood poisoning in poor children. The case, called Matthews, et al. v. Kizer, was filed today in federal district court for the Northern District of California. A copy of the complaint is enclosed. To avoid unnecessary litigation, we would like to explore with you the possibility of whether we can reach an out-of-court settlement.
