RE: RecentS2Decisj_ons
I am enclosing copies of two favorable district courtopinions handed down earlier this month. Harris v. Graddickr 51Sy9u probabry know from the two previous reported opinions, charrenged the treatment of black voters in arabama.specificarry, it attacked the failure to appoint brack polring
officials, restrictions on voter assistancef and a fivelminut6limit on tirne spent in a voting booth. Judge Thornpsonrsdiscussion of !h" pervasiveness of the injury clused by thestate's intentional discrimination, and the -necessity of acorrespondingly broad remedy, see slip op. at L6 and 21-, isparticularly he1pfuI.
chisom v. Roemer charlenges the use of a multi-memberdistrict to elect two justices to the Louisiana Supreme Court.
The attached opinion granted plaintiffs' motion for J preliminary
injunction harting the upcoming election. There are sometroulrl j--ng passages in Judge Schwartz rs opinion--e.g. , hisskepticism about the use of regressionar Lnalysis--uut theirreparable injury, public interesL, and barancing test parts ofthe dj-scussion may be helpful.
Finally, for light readlng, I am enclosing a copy of the
book review Peyton Mccrary and r did of Abby Thernstrom.
I shall be starting at UVA Law School this fall.
