AGREEMENT TO DISMISS APPEAL 
  

It is agreed by the appellants, and by the County School Board 

of New Kent County, the individual members thereof and Byrd W, Long, 

Division Superintendent of Schools for said county, appellees, that 

the above styled proceeding pending in the United States Court of 

Appeals for the Fourth Circuit under Docket No. 10,773 will be dis- 

missed with each side bearing its own costs; and that this agreement 

when filed with the clerk of said court will constitute the clerk's 

authority to dismiss said proceeding pursuant to Rule 23 of said Court. 

This agreement leaves unaffected the appeal taken by said appellants 

against the said appellees which is pending in said Court under Docket 

No. 10,792.
