PRESS RELEASE 

NEW ORLEANS, LA.--The NAACP Legal Defense and Educational Fund, Inc. 

has appealed a suit which it brought against Kaiser Aluminum and 

Chemical Company and a local subsidiary of the Aluminum Workers 

International Union. 

According to the brief filed here in the U.S. Court of Appeals for 

the Fifth Circuit, the LDF charges that Kaiser Aluminum and Local 

205 of the Aluminum Workers of the International Union are denying 

Negro employees equal job opportunities 

The brief states that Negroes are being denied training, promotions, 

and equal use of company facilities. 

LDF attorneys say the suit raises the central question of whether 

or not persons must wait for the Equal Employment Opportunities 

Commission (EEOC) to take conciliatory action before they them- 

selves can begin court proceedings. 

The discrimination charge is an appeal from a lower court which 

dismissed the complaint on grounds that EEOC conciliatory action is 

required before the plaintiffs could appeal to the courts. 

The attorneys, basing their contention on previous court rulings, 

hold that such a delay is not required.
