MOTION TO AMEND JUDGMENT   

COME NOW defendants, by their attorneys, pursuant to 

Rule 59 (e) of the Federal Rules of Civil Procedure, and respectfully 

move the Court for an order amending its Amended Order dated February 

27, 1978, and entered February 28, 1978, in the following respect: 

The Amended Order provides that if the order of this Court 

dated January 3, 1978, granting attorney fees and costs, is ultimately 

affirmed on appeal, then the amount of the award so affirmed shall bear 

interest in the amount of eight percent (8 %) per annum from March 2, 

1976 until paid. Defendants respectfully move the Court to amend its 

Amended Order so as to provide that the eight percent (8 %) per annum 

 



  

interest run from January 3, 1978, the date of the entry of the Final 

Judgment, until paid.
