POST SUBMISSION BRIEF
Judge Sharolyn P. Wood, Respondent herein, would respectfully
call to the Court’s attention, as she noted in her Motion to Divide
Oral Argument time, that the Attorney General for the State of
Texas, for his own political or psychological reasons, did not urge
support for the Fifth Circuit’s majority opinion. Had such a
position been taken by an attorney in private practice, the
Attorney General’s position would have constituted legal malprac-
tice. Having not had an opportunity to argue, Judge Wood can only
respectfully and emphatically urge that the Court study her Reply
Brief and the majority opinion of Judge Thomas Gee which Judge Wood
believes constitute the proper basis for a decision of this
important case.
Accordingly, Judge Sharolyn Wood prays that the Court clearly
and unequivocally affirm the en banc opinion of the Fifth Circuit.
