Dear Sir:
I am principal counsel for the appellant in 

the above noted case. On October 27, 1982, the 
court granted appellant's motion for an 
adjournment of oral argument, which was 
necessitated by the fact that I was out-of-the- 
country on vacation. I am writing to inform the 
court that I have returned, and that I am 
available for oral argument at the court's 
earliest convenience.

I apologize for any inconvenience which my 
absence may have occasioned either for the court 
or your office. I made my vacation plans in 
reliance on my understanding of the court's 
practice of providing a month's notice before oral 
argument. I am particularly chagrined that my 
personal plans required an adjournment of oral 
argument because, in addition to any inconvenience 
to the court, the delay affects my client's 
interest in the speedy resolution of this matter 
which arises out of events occurring in 1974. 
Accordingly, I ask your indulgence in resetting 
oral argument at the earliest time that is 
convenient and practical for the court.

Thank you for your consideration in this 
malter. Once again, I apologize for any 
inconvenience.
