MOTION TO FILE AN OUT OF TIME BILL OF COSTS
TO THE HONORABLE COURT OF APPEALS:
Appellant Dallas County District Judge F. Harold Entz
("Judge Entz") moves the Court to allow the filing of an out
of time bill of costs on the following grounds:
1. The deadline for filing the bill of costs following
the en banc opinion was Friday, October 12, 1990.
2. Although Judge Entz prepared and mailed the bill of
costs prior to the deadline, he inadvertantly sent the court's
copy by certified mail rather than Federal Express. Thus,
instead of arriving at the court on the due date, the bill of
costs arrived the following Tuesday, October 16, 1990.
3. The untimely filing of the bill of costs was
unintentional.
WHEREFORE, Judge Entz requests the Court to permit the
out of time filing of bill of costs.
