NEGROES & WHITES SEEK
CONTINUED INTEGRATION
IN OKLA.CITY SCHOOLS
WASHINGTON, D.C.---The U.S. Supreme Court was asked today to
uphold a U.S. District Court decision ordering a new desegregation
plan for Oklahoma City public schools.
However, the District Court ruling which brought more
desegregation was overturned by the U.S. Court of Appeals on
August 27.
Associate Justice Brennan, acting as circuit justice in
response to argument of NAACP Legal Defense and Educational Fund,
Inc. (LDF) attorneys, overruled the Appeals Court on Sept. 2.
Justice Brennan gave LDF attorneys until September 17 to
petition the entire High Court in behalf of those seeking inte-
gration in Oklahoma City.
The case is unvsual in that some white parents are joining
Negroes in pursuit of integrated classes, in the lawsuit, while
other whites are suing to stop the desegregation plan.
The U.S. District Court concluded that a failure to execute
the desegregation plan of the Oklahoma City School Board would
violate the constitutional rights of the Negro student by continuing
the condemned and unconstitutional State-imposed segregation of the
past.
The LDF is asking the Supreme Court to dispose of the case
with "the least possible delay."
