THE DEAN OF THE COLLEGE. 

THE SUIT CHALLENGES THE LEGALITY OF THE EXP 3IONS BEFORE THE STUDENTS @ 

HAVE BEEN GIVEN A HEARING TO DETERMINE THEIR GUILT OR INNOCENCE OF THE CHARGES 

AGAINST THEM. IT ASSERTS THAT SUCH SUMMARY PUNISHMENT WIT T A TRIAL 

VIOLATES DUE PROCESS OF LAW, AS GUARANTEED BY THE 14TH AMENDMENT OF THE U.S. 

CONSTITUTION.

LDF HAS LONG SOUGHT TO INSURE THE FAARNESS AND REGULARITY OF THE TREAT- 

MENT OF BLACK STUDENTS IN THE NORTH AS WELL AS THE SOUTH. BECAUSE OF THE 

PREVALENCE OF RACIAL DISCRIMINATION IN THIS SOCIETY, IT IS OFTEN ONLY BY 

INSISTENCE ON STRICT ADHERENCE TO STANDARDS OF FAIRNESS THAT THE EFFECTS OF 

SUCH DISCRIMINATION CAN BE ELIMINATED. BY EXTENDING CONSTITUTIONAL STANBARDS 

OF DUE PROCESS TO THE AREA OF THE TREATMENT OF STUDENTS BY OTHERWISE PRIVATE 

INSTITUTIONS, THE FUND WILL FURTHER EXTEND THE CONSTITUTIONAL GUARANTEES 

AGAINST RACIAL DISCRIMINATION.
