MOTION FOR LEAVE TO FILE DEFERRED APPENDIX
_______ PURSUANT TO F.R.A.P. 30 (c)________

Pursuant to Rule 30(c) of the Federal Rules of Appellate
Procedure, appellant respectfully moves the Court for leave
to file a deferred appendix. Appellant's brief is due on
December 4, 1981. Counsel has conferred with counsel for
appellees and both concur that a deferred appendix would be
more manageable in the instant case.

WHEREFORE, appellant prays that his motion for leave to
file a deferred appendix be granted.

Respectfully submitted,
