RE: Rule 30(c) - Deferred Appendix Procedure

The Sixth Circuit encourages use of the deferred appendix 
procedure contemplated by Rule 30(c) of the Federal Rules of 
Appellate Procedure. However, a motion seeking leave to use the Rule 30(c) 
procedure must be filed in the Clerk's office at least ten days prior to due 
date of appellant's brief.

The procedures are as follows:
(1) Appellant's and appellee's counsel are to file one copy of their 
briefs in the Clerk's office and are to serve one copy on every other party 
to the appeal.
(2) These preliminary copies of the briefs should cite references to 
items in the record of district court proceedings, where applicable.
(3) Within three weeks after service of the appellee's brief, 
appellant's counsel is to file the joint appendix.
(4) Within two weeks after service of the joint appendix, the parties 
are to file the required number of briefs. The only changes permitted to be 
made to the preliminary briefs are that references to the record are to be 
replaced with references to the serial pagination of the appendix. Parallel 
references are also permitted.
(5) Your attention is directed to Sixth Circuit Rules 10(d) and (e):

RULE 10(d): "The joint appendix should be consecutively paginated
and a table of contents referencing specific pages of the appendix 
should be prepared. The contents should include;
1. the district court's docket sheet;
2. the complaint or indictment;
3. the judgment from which the appeal is taken and any memorandum 

opinion incident thereto;
4. the notice of appeal;
5. any other matter to which either counsel intends to refer

in their briefs or wishes to bring to the particular attention 
of the Court."

RULE 10(e): "With respect to Rule 30, Federal Rules of Appellate
Procedure and especially Rule 30(c) , references in the briefs to the 
record should be indicated by referring directly to the page numbers 
of the joint appendix."
