The appellant herein, the State of Tennessee,
pursuant to Rule 34 (5), Rules of the Supreme Court,
respectfully makes application for an extension of time
of thirty-two (32) days, up to and including June 4, 1984,
in which to file the Brief of the appellant in this case.
In support of this application the appellant
would show:
(1) The instant case will not be argued until
the October, 1984, session of the Court, thus the
requested extension should not prejudicially impede the
progress of the Court's calendar, nor delay a hearing of
this case.
(2) The undersigned is involved in numerous
pressing litigation and appellate matters that require
a good deal of time and preparation. At the same time
the undersigned is trying to do the extensive research
and preparation necessary to the filing of an adequate
brief before this Court. The present case assignments
of the undersigned thus necessitate the requested
extension of time in order that appellant may file an
adequate brief in this case.
(3) The undersigned has conferred with
counsel for the appellee who states he has no objection
to this requested extension of time to file appellant's
brief.
TO THE CLERK OF THE UNITED STATES SUPREME COURT:

Appellant therefore requests this application
for an extension of time until June 4, 1984, to file
appellant's brief be granted.
