application for the convening of a three-judge district court as required by 

28 U.S.C. $2284 and requests that the Chief Judge of The United States Court 

of Appeals for the Fifth Circuit be notified of this matter in order that 

necessary designation of judges may be made.

The plaintiffs in this matter having commenced the above-entitled 

action challenging the constitutionality of the apportionment of congressional 

districts or the apportionment of any statewide legislative body, and it 

appearing that said matter is required to be heard and determined by a 

district court of three judges,

The above entitled matter came before the Court for a 

status conference on June 7, 1982 at 10:00 a.m. WHEREFORE, 

the Court will and hereby does ORDER the following: 

1) Defendants' motion to sever the trial of 

plaintiffs' claims of malapportionment of Congressional 

Districts and State House of Representatives Districts is 

GRANTED. It is ORDERED that there be a separate trial for 

plaintiffs' claim of malapportionment of Congressional 

Districts and that, subsequently, this Court will try 

plaintiffs' claim of malapportionment of State House of 

Representatives Districts; 

2) Plaintiffs' application for convening a 

three-judge district court is GRANTED; 

3) Plaintiffs' motion to extend time for deter- 

mination of class action is GRANTED, and plaintiffs shall 

have an additional 45 days to move for class certification; 

4) A hearing on plaintiffs' motion for a pre- 

liminary injunction, enjoining qualification of candidates 

for the September 11, 1982 Congressional primary election 

until such time as a constitutional plan of reapportionment 

is established, shall be set for June 28, 1982 at 10:00 

a.m. 

5) A pretrial conference for the preliminary 

injunction hearing shall be set for June 23, 1982 at 3:00 

p.m., and prior to this time, the parties shall meet to 

confect a pretrial order for the preliminary injunction 

hearing; and 

6) Parties shall exchange a list of witnesses, 

who shall or may be called at the preliminary injunction 

hearing, no later than June 11, 1982 at 3:00 p.m.
