Comes now the Defendants Etowah County, Alabama; Lee 

Wofford, in his official capacity as Probate Judge; Billy Yates, 

in his official capacity as Circuit Clerk; and Roy McDowell, in 

his official capacity as Sheriff of Etowah County; and move the 

Court to transfer this proceeding to the United States District 

Court for the Northern District of Alabama, being the Court 

having proper jurisdiction in that the proper venue for the 

action set forth in the amended complaint against these 

defendants properly lies in the United States District Court for 

the Northern District of Alabama, where the acts as alleged in 

the complaint occurred and where Etowah County and its elected 

officials are located and reside.
