I had planned to mail to you last Friday the names of the persons 
to whom the Report was sent from New York, but Lolita Livingston's ■ 
sister died that morning. Also, I was waiting for a corrected 
list which Lolita said was on the way from Charlotte and which has 
not yet arrived. So, I decided to type the attached list myself 
from Lolita's records. There may be a few errors which I shall 
change when she returns but I think this list is basically okay-.
We need to have a correct distribution list, i.e. names should be 
correctly spelled; parsons should be accurately identified and 
addresses including zip codes should be correct. Please note any 
inaccuracies and send the corrections to me. Also, send in the 
names of persons to whom you may have sent the Report. I will 
send out a few more, especially to foundation types, but since I 
want to include a personalized letter, that mailing may have to. 
wait until Lolita returns.

For your information:
1. Most of the recipients received the Report with the double 

letterhead which is enclosed.

■2. I decided that two categories of persons should get first class 
personal letters on one organization's letterhead. After dis­
cussing this with Bob, I wrote to the southern governors on 
MPC letterhead, using Wendell Paris' signature. Cabinet officers 
and Congressmen were sent first class letters on LDP letterhead 
over my signature. Copies'of these letters are enclosed.

Let's plan to share any responses as soon as they come in. Also, I 
shall be interested to know how you two plan to respond to the Corps' 
letter which you should be receiving any time now.

Council on the Tennessee Tombigbee Waterway and the NAACP Legal

This Report contains important information, analyses and observa­
tions which should concern you as a private citizen and as one 
who is directly involved with the Waterway through your organiza­
tional and professional relationships. We specifically direct 
your attention to the Report's Findings and Recommendations on 
pages 7-16.
On August 8, 1977, we submitted this Report to Secretary of the 
Army, Clifford Alexander, and to Lieutenant General J. W. Morris, 
Chief of the Army Corps of Engineers. Representatives of our 
two organizations met the following day with Lieutenant General 
Morris, with other officials of the Corps and with representatives 
of Secretary Alexander's office. We were advised that we would 
receive their response to this Report and to our recommendations

of waterways has become a national issue but especially be­
cause HUD is already deeply.involved in this Waterway. One 
of the major concerns in this report is the underrepresentation 
of blacks in the Waterway's policy-making and planning agencies. 
Inasmuch as HUD provides financial assistance to these bodies, 
we would like to know what steps you are taking to ensure 
full compliance with Title VI of the Civil Rights Act of 1954.

This le t te r  is  w ritten  to introduce you to the M inority Peoples 
Council on the Tennessee-Tombigbee Waterway and request your 
assistance in  a major le ga l challenge to the control and d irection  
o f this Federally sponsored public works pro ject.

The Minority Peoples Council is  a coa lition  o f interested 
organizations and individuals in the Tennessee-Torabigbee Waterway 
impact area who are working to insure that minority people receive 
a fa ir  and proportionate share o f the benefits o f th is m u lt i-b illion  
do lla r Federally financed public works p ro ject, currently under 
construction in  southwest Alabama and northeast M ississipp i. We 
have determined from U.S. Census data that approximately fo r ty  
(40%) o f the over one m illion  residents, in  the sixteen (16) county 
primary impact area o f the p ro ject, are Black.

In developing a rationale fo r  the Tennessee-Tombigbee Waterway 
P ro ject and supporting arguments to ju s t i fy  the cost-benefit ra tio  
o f the p ro ject. The U.S. Army Corps o f Engineers has re lied  heavily 
on the "re-development ben efits " o f the pro ject. These benefits are 
calculated on the basis o f the e ffe c t  of the pro ject on depressed 
areas in terms o f reducing unemployment, under-employment and out­
migration, An examination o f the s ta t is t ic s  w i l l  show that Black 
people have the severest problems in  these respects. Thus to a 
great extent a major rationale fo r  the project is  i ts  supposed 
b enefit to Black and poor people, which we fe e l  has thus fa r  not 
been fu l f i l le d .

The Minority Peoples Council has developed a comprehensive 
program in ten areas to work toward the fu l l  Involvement and p a r t ic i­
pation o f Black people in the construction and subsequent develop­
ments arising from the Waterway, have enclosed a copy o f the 
"Peoples Guide to the Tennessee-Tombigbee Waterway" which deta ils  
our ob jectives and program.

Among the areas we have been most active  in ares

-promoting minority employment both in construction and 
in  industries that locate fa c i l i t i e s  in conjunction with 
the waterway;

-seeking m inority partic ipation  on the decision making 
boards, i . e . ,  Tennessee-Tombigbee Waterway Development 
Authority, Tombigbee R iver Valley Water Management D is tr ic t ,
port commissions, .p lann ing.d istricts,, and others, that control the plannifeg and S irection  o f the pro ject.

We have attempted to develop a th ree-fo ld  approach to dealing 
with each o f these ob jectives -  negotiations, le g is la t iv e  change and 
l it ig a t io n .

With the assistance o f the labor unions who are working on the 
pro ject we have drawn up an "Areawide M u lticra ft A ffirm ative Action 
Agreement" which has as a goal, 40% minority h ir in g  in a l l  phases o f 
construction o f the TTW P ro ject (copy enclosed). The agreement 
provides fo r  the recruitment, tra in ing and placement o f minority workers 
on the TTW P ro ject. I f  accepted by the contractors and approved by 
the government compliance agencies, th is agreement would become part 
o f the U.S. Army Corps o f Engineers bidding specifica tions fo r  the 
pro ject.

Thus fa r we have been unable to get the contractors to agree to 
sign the plan, prim arily because the government agencies involved, 
i . e . ,  U.S. Army Corps o f Engineers, O ffice  of Federal Contracts 
Compliance (OFCC) and Department o f Defense Contracts Compliance 
Agency (DOD-CCA) , have not backed the need fo r  a plan and the plan 
i t s e l f .  This is  despite the fa c t that Executive Order 11246 and other 
laws require an a ffirm ative action plan fo r  minority employment for 
any Federal contract with a value o f more than $10,000. I t  appears 
without le ga l pressure on the contractors and the government 
compliance agencies-no rea l fa ir  employment po licy w i l l  be developed.

In the le g is la t iv e  area, we have prepared some new authorizing 
le g is la t io n , which would require the U.S, Army Corps o f Engineers 
to set aside 3% o f the annual appropriation fo r  the Tennessee- 
Tombigbee Waterway to fund a "M inority Resource and Oversight 
Center". A precedent fo r  th is le g is la t io n , which creates a 
sim ilar resource center, is  included in  the recently passed Railroad 
R ev ita liza tion  and Reorganization Act o f 1975, L eg is la tive  
recognition by Congress o f the importance o f minority participation  
in the Tennessee-Tombigbee Waterway as the la rgest public works 
p ro ject now under construction in  the U.S. would give impetus to  our 
program. Major l i t ig a t io n  to enjoin construction o f the Tennessee- 
Tombigbee Waterway u n til minority demands were met could aid in the 
development and success o f the le g is la t iv e  strategy.



The M inority Peoples Council has established a Legal Committee 
composed o f minority and other lawyers, in  private practice, in the 
impact area who are concerned about the goals o f the Council. This 
Legal Committee is  co-chaired by Attorney Randolph Walker (Pennington, 
Walker, and Turner o f West Point, M ississipp i) and Attorney Booker 
T. Forte (Forte and England, Tuscaloosa, Alabama). About a dozen 
other attorneys from the TTW impact area are active in  the MPC 
Legal Committee, however, since a l l  the lawyers are engaged in 
private practice and the MPC has lim ited  funds, there is  a need for 
more expert le ga l assistance to aid the MPC in pursuing a lega l 
strategy r e la t iv e  to the Waterway.

We are requesting your advice and assistance in developing, 
researching and implementing a le ga l challenge to the Tennessee- 
Tombigbee Waterway to insure Black people a fa ir  and proportionate 
share o f the b en efits . At th is time, we fe e l  that we would lik e  to 
get an injunction to stop the pro ject en tire ly  u n til there is  a 
strong a ffirm ative  action program fo r  employment o f m inorities and 
more Black partic ipation  on the decision making bodies that control 
the Waterway, We have deta iled  f i l e s  and documentation on the 
issues mentioned above which can be made ava ilab le i f  you are 
interested in pursuing th is case further. We hope you w i l l  contact

I  have just returned to the o f f ic e  from my tr ip  to New York and 
Washington. Our meeting with General J. W. Morris, Chief o f Engineers, 
was very worthwhile. Morris promised us a sp ec ific  w ritten answer to 
our recommendations by September 1. When we receive th is response, 
we w i l l  be able to b etter gauge the results o f our a c t iv it ie s  and make 
more d e fin ite  plans for future actions.

A l l  the persons that we showed the report to were very impressed 
by i t  and fe e l  that i t  should help to c lea rly  indicate the strength o f 
MFC’ s experience and leadership re la t iv e  to the Tennessee-Tombigbee 
Waterway.

Enclosed is the edited version of THE "WHITE" PAPER. Fifteen 
copies are being mailed today to John and five to Bob. Our 
comptroller advised us that it costs LDF 10<̂  a page, includ­
ing labor, to produce a report. However, we will charge MPC 
only $5.00 a copy.

This office is willing to handle the mailing to agencies and 
individuals whom you recommend. Please have your names and 
addresses- here by Thursday, August 25. I suggest that John 
and Bob should confer and decide whether to prepare a joint 
cover letter which would be jointly signed, or whether each , 
organization should have a cover letter on letterhead. Also,
I need to know your suggestions for the timing of this mailing. 
Bob and I had discussed earlier the advisability of including 
with the edited document an analysis of the Corps' report to 
Congress.

It is my understanding that the report and this analysis should

The report entitled. The 'Tennessee Tombigbee Waterway 
Project, A "White" Paper.reviews the almost complete 
absence of meaningful black, participation in all aspects 
of this major Corps of Engineers Civil Works Project 
which is funded directly and indirectly by most Depart­
ments and agencies of the Federal government.

At your earlier suggestion, we are meeting tomorrow 
at 3:00 p.m. with Lt. General J.W. Morris, Chief of 
Engineers, to discuss with him our views and recommenda­
tions on minority participation in the Tennessee Tombigbee 
Waterway Project. Since many of our recommendations are 
specifically directed to you as Secretary of the Army and 
supervisor of the Corps' activities, we feel it would be 
appropriate for you or a representative of your staff to 
attend this meeting, .

We are sending copies of this letter and the report to 
several persons on your staff who met with us in the past 
and were concerned about and interested in the views of 
the Minority Peoples Council.

mendations concerning the Corps' internal equal opportunity program 
are set forth in that document.

Tour other letter transmitted a copy of the Mobile District's 
latest SK3 Progress Report for JVpril 1, 1977-Septeinber 30, 1977. At 
this time X  do have one observation concerning that Report. That is, 
I find it ironic that the Report, as other Corps reports do, equates 
females with minorities. l recommend that you discontinue this 
practice as it* effect is that by hiring or promoting white wcHnen you 
are able to reach whatever goals you have set and still maintain job 
categories segregated on the basis of race.

I had planned to mail to you last Friday the names of the persons 
to whom the Report was sent from New York, but Lolita Livingston's 
sister died that morning. Also, I was waiting for a corrected 
list which Lolita said was on the way from Charlotte and which has 
not yet arrived. So, I decided to type the attached list myself 
from Lolita’s records. ' There may be a few errors which I shall 
change when she returns but I think this list is basically okay-.
We need to have a correct distribution list, i.e. names should be 
correctly spelled; parsons should be accurately identified and 
addresses including zip codes should be correct. Please note any 
inaccuracies and send the corrections to me. Also, send in the 
names of persons to whom you may have sent the Report. I will 
send out a few more, especially to foundation types, but since I 
want to include a personalized letter, that mailing may have to-, 
wait until Lolita returns.

For your information;
1. Most of the recipients received the Report with the double 

letterhead which is enclosed.

2. I decided that two categories of persons should get first class 
personal letters on one organization's letterhead. After dis­
cussing this with Bob, I wrote to the southern governors on
MPC letterhead, using Wendell Paris' signature. Cabinet officers 
and Congressmen were sent first class letters on LDF letterhead 
over my signature. Copies'of these letters are enclosed.

Let's plan to share any responses as soon as they come in. Also, I 
shall be interested to know how you two plan to respond to the Corps' 
letter which you should be receiving any time now.

Council on the Tennessee Tombigbee Waterway and the NAACP Legal

This Report contains important information, analyses and observa­
tions which should concern you as a private citizen and as one 
who is directly involved with the Waterway through your organiza­
tional and professional relationships. We specifically direct 
your attention to the Report's Findings and Recommendations on 
pages 7-16.
On August 8, 1977, we submitted this Report to Secretary of the 
Army, Clifford Alexander, and to Lieutenant General J. W. Morris, 
Chief of the Army Corps of Engineers. Representatives of our 
two organizations met the following day with Lieutenant General 
Morris, with other officials of the Corps and with representatives 
of Secretary Alexander's office. We were advised that we would 
receive their response to this Report and to our recommendations

of waterways has become a national issue but especially be­
cause HUD: is already deeplyinvolved in this Waterway. One 
of the major concerns in this report is the underrepresentation 
of blacks in the Waterway's policy-making and planning agencies. 
Inasmuch as HUD provides financial assistance to these bodies, 
we would like to know what steps you are taking to ensure 
full compliance with Title VI of the Civil Rights Act of 1964.

of the role which Interior plays at the request of President 
Carter in evaluating all of the yater projects which were re­
viewed last.spring and we Rnow o f ‘yo^r deep personal concern 
about the impact on minority"groups and the poor of large 
economic development projects. MPC leaders appreciated the 
meeting with you earlier this year and want to have a continu­
ing relationship not only with you personally but with the 
appropriate agencies in Interior who ought to be more closely 
involved in the Tennessee Tombigbee Waterway than they are 
now.
