Dear Jim:
TI have reviewed the order and decree
awarding attorneys' fees.
I urge you to file a cross-appeal
from the judgment. I think the issues
are:
whether as a matter of law you are
entitled to a "bonus" deriving from
the contingent nature of the fee;
and,
whether a defendant in our cases
can claim indigency.
Both are very important issues and I think
can be won. I am willing to provide you
with some help in preparing the brief on
this case.
I return to you the judgment and
opinion.
