Dear Jim and Norman: 

I enclose a proposed order on remand requested by Judge 
Keady. He has set the matter for hearing on Wednesday 
in Greenville. I will be on vacation at that time 
(hopefully somewhere in the Caribbean) and Ms. Nausead 
Stewart will represent plaintiffs at that hearing. 

Would you kindly review the proposed certification pro= 
cedure and telephone Nausead with any further suggestions 
no later than Tuesday afternoon. The present order draws 
heavily from Green v. Connally, 330 F. Supp at 1170-1180.   

Norman, I read your summary of Norwood. I don't see how 
you can read Section V as indicating anything more than 
that the issue of specific relief is wide-open. Didn't 
we decide to litigate only those issues resolved in our 
favor before the Supremes? I find the opinion perfectly 
acceptable and I like the idea of having a shot at Judge 
Keady (the three-judge district court has been dissolved) 
on this question before fighting the issue on appeal. 
Frankly, I believe Judge Keady will rule in our favor and 
that the State will have to carry the appeal.
