I am enclosing copies of the briefs the defendants
have filed along with their nehr counseUs cover letter.
As I mentioned, we shall probably move for issuance ofthe mandate and an injunction against the Septernber
election.

Incidentally, the Court of Appeals, opinions in
Mallory v. Eyrich and Chisom are nohr reported. The
fuII set of opinions in Mallory is 666 F. Supp. LO6O(S.D. ohio L9g7), revrd 839 F.2d 275 (Gth cii: 1988);
the fuII set in Chisom is 659 F.. Supp. LB3 (8.D. La.
L987) , rev'd, 839 F.2d 1056 (Sth Cir. 1988).
