September 8, 1997 served upon plaintiffs-respondents on October 

9, 1997, and upon the opinion and judgment of the Supreme Court, 

Queens County (Posner, J.) entered on February 5, 1997, 

plaintiffs will oppose defendants’ Motion for Leave to Appeal to 

the Court of Appeals, and in the alternative, will move this 

Court for leave to appeal the dismissal of the first and second 

causes of action on October 17, 1997 at the Courthouse on 45 

Monroe Place, Brooklyn, New York.
