election under Rule 30 (c) of the Federal Rules of
Appellate Procedure and Local Rule 13 (e) of the
United States Court of Appeals for the Fifth Circuit
to defer the filing of an appendix in the above-styled
cause until twenty-one (21) days after service of the

MOTION TO EXTEND TIME FOR
FILING OF TRANSCRIPT
Come now the Appellants herein, through under-
signed counsel, pursuant to Rule 11 (4d) and 12 (a) oi
the Federal Rules of Appellate Procedure and move
this Court to extend the time for the filing of the
transcript for 14 days until March 4, 1977, for the
following reasons:
1. The District Court has previcusly granted
a Fifty (50) day extension of time for filing of the
record, pursuant to Rule 11 (d) of the Federal Rules
of Appellate Procedure, which time expires on February
77.
2. Tha Clerk of the District Court has
counsel for the Appellants that the record, except for
the transcript, will be ready for filing as of February 17,
1977. However, the court reporter has informed counsel
for the Appellants that the transcript of the proceedings,
which is approximately 1500 pages in length, is not
finished, and he will require another 14 days for its
completion.
3. Pursuant to Local Rule 8 (c) of the United
States Court of Appeals for the Fifth Circuit, attache
is a letter of explanation from the court reporter.
WHEREFORE, Appellants pray that the time for
filing of the transcript be extended for 14 days until
March 4, 1977.

Dear Mr. Tidwell:
With regard to our telephone conversation of yester-
day, I am requesting, in writing, an extension bu roguested of The
Fifth Circuit Court of Appeals of fourteen (14) days to and
including the 4th day of March.
I find it necessary to request this extension because
within the last ninety (90) days I have had to also xangoribe
a lengthy criminal appeal consisting of some 1536 pages another
of 497 pages in addition to the 1130 pages completed on this.
I am now working on the last afternoon of testimony and have only
the arguments to complete.
