Dear Counsel: Having found the Amicus brief of the Justice Department in the original appeal of this cause extremely helpful, the Court would appreciate being advised of the Justice Department's position concerning the following: (1) the district court's grant of the preliminary injunction; (2) the appellants' motion to this Court for stay of the preliminary injunction pending appeal; (3) whether this Court should now stay so much of the preliminary injunction, if any, as prohibits the qualification actions to be taken during the period of July 27-29, 1988, pending decision on the balance of the requested stay or on the merits of the appeal of the preliminary injunction. The Court would appreciate receiving the Justice Department's response, if any is to be made, as soon as practicable, and as to item (3) by not later than July 25, 1988. Very truly yours, GILBERT F.
