Re: Extension of Time to File Brief on the Merits and Joint

Appendix in Hunt v. Cromartie, Nos. 99-1864 and 99-1865

Dear Ms. McNerney:

The State appellants’ and appellant-interveners’ briefs on the merits and the joint appendix are now

due in the above referenced appeal by August 21,2000. Asa result of the extensive evidentiary record and

continuing negotiations with outside counsel experienced in Supreme Court practice who may assist the

State with this appeal, additional time is needed to file the brief on the merits ana the joint appendix. In

crder to allow the State sufficient time to prepare its brief and complete negotiations with additional counsel,

the State is seeking an extension to and including September 8, 2000. This extension essentially allows 10

additional days with a few extra days to account for the Labor Day holiday.

Undersigned counsel has contacted counsel for the appellees and for the appellant-interveners about

the requested extension of time and has been authorized to represent to the Court that they have no objection

to an extension of time to and including September 8, 2000.

Please do not hesitate to contact this office if any additional information is needed.

Sincerely,

Tiare B. Smile
