Dear Mr. Johnson;
Pursuant to your telephone conversation of this date with Mr.
Douglas West, I would like to confirm that A llen Park Public Schools,
et al, Southfield Public Schools, Grosse Pointe Public Schools and the
School D istrict of the City of Royal Oak request that the record with
respect to the captioned matter not be transmitted to the Court of A p
peals for the Sixth Circuit. The Notice of Appeal was filed on behalf
o f A llen Park Public Schools, et al, Southfield Public Schools and
Grosse Pointe Public Schools on June 20, 1972, and the Notice of A p
peal was filed on behalf of the School Distric
Oak on July 12, 1972.

This request that you not transmit the record is made in
further pursuance of Mr. West's telephone conversation with James
Higgins, Clerk of the United States Court of Appeals for the Sixth C ir
cuit, in light of the subsequent appeal from the D istrict Court's Order
of July 20, 1972. It has already been set for hearing by the Court of
Appeals on August 24, 1972.
