VERSUS NO. 86-4075 

EDWIN EDWARDS, ET AL SECTION: "A" 

ORDER  

The Court, after considering the complaint filed in the 

above captioned matter, and the request for convening a three 

judge court declines to enter an ex parte order for such and in 

lieu thereof shall hold a hearing at which the parties are directed 

to file a memorandum addressing the following issues: 

(1) Whether 28 U.S.C. §2284, which pertains to 
the issuance of injunctions "when an action 
is filed challenging the constitutionality 
of the apportionment of Congressional districts 
or the apportionment of any statewide 
legislative body" requires the convening of a 
three judge court based upon the allegations of 
this complaint. 

(2) Whether 48 U.S.C. §1973c which, inter alia, 
pertains to the prohibition of "tests or devices" 
that are aimed at abridging minority voting rights, 
requires the convening of a three judge court based 

upon the allegations of this complaint. 

Accordingly, 

IT IS ORDERED that parties appear for arguments Wednesday, 

October 15, 1986 at 2:30 P.M. and deliver to this Court memorandum 

no later than October 10, 1986.
