The U.S. Court of Appeals for the Second C§rcuit in N.Y¥.C. will hear arguments 

tomorrow (October 1#) in a case involving efforts of a black citizens' or- 

ganization in Lackawanna, N.¥., to construct homes outside the City's all- 

black First Ward in an area almost exclusively white. The appeal, brought 

by the City, seeks reversal of a ruling by the U Distwict Court in 

Buffalo which ordered it to take affirmative ac to permit construction 

of the development, by e Kennedy rk Homes Association. Kennedy Park is a 

non-profit housing corporation formed in 1968 by a group of black citizens 

in reaction to the deplorable conditions under which Lackawanna's baacks 

have been forced to live.
