Dear Mr. Riggins:
This is to acknowledge receipt of your notice
that oral arguments will be heard on February 8, 1973,
at 2 p.m. in the rehearing in banc of the above appeal.
Mr. David L. Norman, Special Assistant to the
Attorney General, will be present to represent the United
States at the oral arguments in order to address the
Court briefly on the question of inclusion of school
districts other than Detroit in the relief order of the
district court. Ten minutes should be a sufficient
amount of time for his presentation.
Pursuant to an order of this Court, we partici
pated in the previous arguments on the question of the
affect of Section 803 of Pub. L. 92-318 and would
appreciate the allowance of some time to present our
views at the in banc hearing. In view of the govern
ment's position as an intervenor pursuant to an order
of this Court, however, perhaps it would be more appro
priate to allot time for the government's presentation
outside the time allotted, for the principal parties.
Should the Court consider such an allowance
of time infeasible, we will, in any event, be present
at the hearing in case the Court has any questions to
direct to us.
