Dear Sir: 

With reference to Mr. Tidwell's letter of September 17, 1979 
we also agree that oral argument on the appeal be continued 
until the Supreme Court has ruled on the issues in these 
cases presently pending before it. This agreement is premised 
upon the assumption that these cases will be calendered for 
oral argument shortly after the ruling by the Supreme Court. 

In conversation with your office today I was informed that in 
light of the particular circumstances of these appeals and the 
agreement of the parties for a continuance of the oral arguments 
the continuance would be granted and therefore we are not pre- 
paring a supplemental brief as suggested in your notice scheduling 

the oral arguments.
