Gentlemen:

We have this morning rece ived  Judge Roth's severa l  orders  in 
the above-re fe renced  matter and note part icu lar ly  the fo llowing paragraphs 
in the Class Act ion  Order:

"The Court takes judicial notice of the fact that 
this lawsuit has rece ived  w idespread, pervas ive  
publicity through the mass news media, and that the 
ord inary news coverage  in such mass news media of 
this order w i l l  e f fec t ive ly  and adequately place a ll  
interested m em bers  of the c lasses on notice of the 
pendency of the action, and its nature and purpose;

"W H E R E FO R E , NO TICE  IS H E R E B Y  G IVEN 
that the Court has determined that the plaintiffs in 
this action represent a ll  school children in the City 
of Detro it ,  Michigan, and a l l  Detro it  resident parents 
who have children of school age, and that this action 
seeks to have declared as unconstitutional the alleged

maintenance and perpetuation of a segregated public 
school system in the City of Detro it ,  Michigan.

"Any m em ber of the classes described above who 
be l ieves  that his interest in the action is not or w i l l  
not be fa i r ly  and adequately represented by the parties 
plaintiff, shall f i le  his appearance in this cause and 
accompany the same with a statement of reasons for 
such belie f .  Such appearances must be filed with the 
C lerk  of the Court not later than M arch  8, 1971. In 
the event appearances or interventions are  filed on or 
be fore  said M arch  8, 1971, the Court w i l l  conduct a 
hearing on M arch  15, 1971 at ten o 'c lock  in the forenoon 
in its Courtroom, 257 F edera l  Building and Courthouse, 
Detro it ,  Michigan, to consider such appearances and/or 
interventions and to outline procedures to be followed in 
these p roceed in gs . "

In light of the above, I would respectfu l ly  suggest that it is 
incumbent upon you, as counsel fo r  plaintiffs, to prepare a press re lease  
going to a l l  newspapers that are  circulated within the City of Detroit  and 
make certain that the substance of the above, if not the l i te ra l  language of 
Judge Roth's Order, is brought to the attention of a l l  those whom you 
purport to represent as mem bers  of the two c lasses.
