The Crenshaw County defendant-intervenors having satisfied the 

award made by this court on March 4, 1987, and the plaintiffs having 

indicated that they therefore have no objections to the motion to dismiss 

filed on March 18, 1987, by the Crenshaw County defendant-intervenors, it is 

ORDERED that the motion is granted and that the Crenshaw County defendant- 

intervenors are dismissed.

Based upon the representations made, at a March 20, 1987, 

in-chambers conference, by counsel for all parties involved in the second 

phase of this lawsuit initiated by the plaintiffs' March 6, 1987, amendment 

to complaint, it is ORDERED: 

(1) That a class certification hearing is set for June 24, 1987, 

at 10:00 a.m. in the second floor courtroom of the federal courthouse in 

Montgomery, Alabama, with the plaintiffs to file their brief and evidentiary 

materials by May 22, 1987, and the defendants to do the same by June 16, 

1987; 

(2) That the trial on liability is set for October 26, 1987, at 

10:00 a.m. in the second floor courtroom of the federal courthouse in 

Montogmery, Alabama; 

(3) That the pretrial conference on liability is set for 

September 25, 1987, at 2:00 p.m. at the federal courthouse in Montgomery, 

Alabama; 

(4) That the parties are to complete discovery and exchange lists 

of witnesses and exhibits as to liability by September 25, 1987; 

 



  

(5) That the trial on remedy is set for January 19, 1988, at 

10:00 a.m. in the second floor courtroom of the federal courthouse in 

Montgomery, Alabama; 

(6) That the pretrial conference on remedy is set for December 

14, 1987, at 2:00 p.m. at the federal courthouse in Montgomery, Alabama; and 

(7) That the parties are to complete discovery and exchange lists 

of witnesses and exhibits as to remedy by December 14, 1987, 

For each pretrial conference, the parties are DIRECTED to prepare 

and submit to the court a proposed, joint pretrial order.

For good cause, it is ORDERED that all parties show cause, if any 

there be, in writing within 14 days from the date of this order as to why 

the aspect of this lawsuit dealing with the following defendants should not 

be closed and the clerk and all parties should not be relieved of the 

responsibility of serving future pleadings and orders on said defendants: 

the Calhoun, Coffee, Crenshaw, Escambia, Etowah, Lawrence, Lee, Pickens, and 

Talladega County defendants.
