States has recently denied petitions for certiorari in two cases cited by plaintiffs on page 14 of the 
Final Pretrial Order under the section entitled: “Plaintiffs” Contested Legal Contentions.” The 
cases are: Valdespino v. Alamo Heights Independent School District, 168 F.3d 848 (5™ Cir. 
1999), cert. denied, 67 U.S.L.W. 3773, 68 U.S.L.W. 3026 (U.S. Jan. 18, 2000) (No. 98-1987); 
Perez v. Pasadena Independent School District, 165 F.3d 368 (5™ Cir. 1999), cert. denied, 67 
U.S.L.W. 3684 (U.S. Jan. 18, 2000) (No. 98-1747).
