Western District of Tennessee.

THIS CAUSE came on to be heard on the record from the said 
District Court and was argued by counsel.

ON CONSIDERATION WHEREOF, It is now here ordered and adjudged 
bv this court that the judgment of the said District Court in this case
be and the same is hereby reversed and the case is remanded for further 
proceedings consistent with the opinion of this Court.

It is further ordered that Plaintiff-Appellant recover from 
Defendants-Appellees the costs on appeal, as itemized below, and that 
execution therefor issue out of said District Court, if necessary.
