The Court of Appeals has remanded this case following
following the decision of this Court in September, 1976, in
light of Monel1 v. Dept, of Social Services, 436 U.S. 658
(1978) . The Court of Appeals has expressed in its Opinion,
____ F.2d ____ (6/18/79), that there remain four questions
in the case.
The parties, through counsel, are invited within
forty (40) days to submit a memorandum as to whether further
hearing and trial is necessary and/or whether the questions
may be resolved on the record with the opportunity for
submission of briefs and mem.oranda and argument.
