MOTION TO CONSIDER ADDITIONAL EVIDENCE

Plaintiffs Gingles, et al. , move that the court consider
as evidence in this acLion the additional exhibits attached
hereto as Gingles Exhibits 90, gL, and 92. rn behalf of this
Motion plainriffs say:

1. It is general public knowledge and subject to judicial
notice, that Harvey Gantt, who is b1ack, was elected Mayor of
the city of charlotte in an election held on November g, 1983,

after the trial of this matter. rt is also subjecr to judicial
notice that he is the first black person to hold that position.

2. Exhibit 90 is a certified copy of the official abstract
of votes cast for I'Iayor and City Council at large at the November

8, 1983 election for the City of Charlotte.
3. Exhibit 9L is the official tabulation of registered

voters by race by precinct for the November 19g3 election for
the City of Charlotre.



4. Exhibit 92 is a notorLzed letter from the Supervisor

of Elections of Mecklenburg county specifying the race of each

of the candidates for Mayor and for the city council at large.
5. Exhibits 90-92 demonstrate that Gantt, the black

candidate for Mayor, won in only nine of the 7o precincts which

are majority white in voter registration. rn contrast he won

in each of 18 precincts which is 502 or more black in voter
registration.

6. Exhibit s 90-92 further demonstrate rhar both black
candidates for city Council at 1arge, Davis and Stratford, lost,
placing seventh and sixth respectively out of eight candidates

competing for four seats.

7. Davis and Stratford each placed sixth, seventh or

eighth in 6l of Lhe 70 precincts which are majority white in
voter registration. one or both of them won in only six of
the 70 majority white precincts. rn contrast, Davis and

Strarford placed first and second in each of the lg precincts
which is 502 or more black in voter registration.

8. Since Charlorte is in Mecklenburg County, one of
the counties in question in this action, the results of this
election may be pertinent to the decision of the court.

9. Plaintiffs do not currently have the results of
other municipal elections which have been held since the trial
of this action. If the Court so desires, plaintiffs will obtain
the relevant vote abstracts and voter registration data for the
municipalities in the other counties in controversy and submi:
them to the Court.
