UPDATE - N.C. Reapportionment Ll8/82
I. Department of Justice
A. Objected to ConsLitutional Amendment, Senate and
Congressional P1ans.
B. House plan pending - decision must be made by
January 20, L982.
C. Note: It is debatable whether or not the State
constitutional amendment can be applied to the
60 non-$5 counties.
II. Republican Lawsuit
A. It has been removed to the Eastern District of North
Carolina.
B. Answer due soon.
C. North Carolina Attorney General plans to move to
consolidate.
III Legislative
A. Has not scheduled new sessi-on - aPParently House and
Senate can't agree when.
B. Senate plans to redistricE - splitting some countys
but not single member districts.
C. House is fighting to keep its p1an.
D. Apparently the Congressional plan will be done over,
putting durham in Second District.
IV. Gingles v. Edmisten
A. Discovery
t. Deadline FebruarY 19, L982.
2. Motion to Quash denied. No depositions scheduled.
3. No interrogatories or requests to produce scheduled.
B. Class Certification
Motion mostly prepared - Attorney General will tell us
on January 11, whether they will consent. They are con-
cerned about overlapping class of republicans.
C. Motion for Summary Judgment - Possibly ripe for
1. Senate Plan
2. Congress Plan
D. Order thag we be ready for final pretrial conference by
February L9, L982.

A. Met with McNeil Smith yielding a few ideas about proving
unresponsiveness .
B. Met with John Brooks.
VI. Computer
A. A11 counties on computer by township.
B. Mecklenburgr Gaston, Guilford, Forsythe, Orange, Cr:mberland,
Wake on computer by enumeraEion district.
C. Sti11 working on Durham, New Hanover, Buncombe.
D. Has Senate plan with 4-5 majority minority districts.
E. Anticipates House plan by January L6, 1982.
F. Program not interactive - much work being done by hand.
