. PROPOSED ORDER OF PRIVATE APPELLANTS 
  

Pursuant to this Court's order of October 31, 1969, 

directing each of the parties to file a proposed order 

"which will properly effectuate and implement the opinion 

and decree of the Supreme Court of the United States 

rendered on October 29, 1969", private appellants propose 

the following order: 

Pursuant to the opinion and decree of the 

Supreme Court of the United States rendered on October 

29, 1969, it is hereby ORDERED: 

1. That each of the school districts here       
 



      

involved may no longer operate a dual school 

system based on race or color and must immediately 

operate as a unitary school system. 

2. That each of the school districts here 

involved, with the exception of Holmes County, Hinds 

county and Meridian, shall implement at once - and 

in no event later than eight (8) days from the date 

hereof - the desegregation plans submitted to the 

District Court on or about August 11, 1969 by the 

Department of Health, Education and Welfare. 

As to Holmes County, Hinds County and 

Meridian, the Department of Health, Education and 

Welfare is directed to submit to this Court within 

five (5) days hereof desegregation plans providing 

for immediate conversion of these districts to 

unitary school systems. Immediately after submission, 

these plans shall be implemented by these districts. 

3. That while each of these school systems is 

being operated as a unitary system under the plans 

described in Paragraph 2 above, the District Court 

may hear and consider objections thereto or proposed 

amendments thereof and may make recommendations to 

this Court with respect to any modifications of these 

plans which it deems necessary and proper to achieve 

unitary school systems. 

4. That this Court shall retain direction and 

control of each of these cases to assure prompt and 

faithful compliance with this order and shall accord 

all proceedings herein the highest priority. 

  

 



  

5. Costs and counsel fees shall be awarded 

to counsel for the private appellants, taxable 

against the United States and appellees.
