Dear Bernie:

I think I owe you a few opologies. My lack of responsiveness
to your calls and letters is not any laek of appreciation of
your offer to help us. Rather it reflects the constant state
of flux in which this litigation has been since it was filed.
As you may know, the NorEh Carolina General Assembly enacted
four different apportionment plans before one was accepted
by the Department of Justice. This put our litigation plans
constantly up in the air.
Things have settled down some now and we are.anticipating an
end of discovery in October or November L982 with a trial
probably around the first of the year. I am very impressed
by your materials which I have read and am most interested in
having you participate in any way in which you feel comfortable.
I have spoken to Lani Guinier at the Legal Defense Fund and
she indicates that paying your travel expenses across the
country will not be a problem. You should expect to hear from
Lani sometime shortly after you return to this country. At
that time you can discuss the scope of your Possible testimony
with her. In addition, you can let her know what information
you need from us in order to be able to prepare your testimony.
